CyberLynk Network, LLC - Terms of Service

This legally binding agreement (this “Agreement”), between Wisconsin CyberLynk Network, Inc. (“CyberLynk”) and Customer governs provision of CyberLynk’s service (the “Service”). This Agreement is effective as of the moment Customer (a) indicates assent through the CyberLynk Website or (b) indicates assent through a CyberLynk branded website or (c) establishes an account with CyberLynk or uses the Service or any element thereof. CyberLynk, in its sole and absolute discretion, may change or modify this Agreement and any policies or agreements which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon posting to this Site or Branded Site. You acknowledge and agree that (i) CyberLynk may notify you of such changes or modifications by posting them to this Site and (ii) your use of this Site or the Services found at this Site after such changes or modifications have been made (as indicated by the “Last Revised” date at the top of this page) shall constitute your acceptance of this Agreement as last revised. If you do not agree to be bound by this Agreement as last revised, do not use (or continue to use) this Site or the Services found at this Site.

1. Account and Personal Email

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times. If you have a domain name registered with CyberLynk, it is your responsibility to ensure that the contact information for your domain account and your actual domain name(s) is correct and up-to-date. CyberLynk is not responsible for a lapsed registration due to outdated contact information being associated with the domain. If you need to verify or change this information, you should log into our secure client portal via https://secure.cyberlynk.net. Providing false contact information of any kind may result in the termination of your account. In certain circumstances, such as a dedicated server rental, colocation arrangement or high risk transactions as determined by CyberLynk, it may be necessary to provide government issued identification and/or a scan of the credit card used at the time of purchase. If you fail to meet these requirements, the order may be considered fraudulent in nature and be denied.

Ownership
The credit card holder or owner of the PayPal e-mail address which is utilized for payment on the account is designated as the authorized owner of the account.

Dedicated IP Address Allocation
Requests for additional IP addresses will require proper justification. Justification requirements are subject to change to remain in conformity with policies of American Registry for Internet Numbers (ARIN). We reserve the right to deny any dedicated IP request based on insufficient justification, current IP utilization, or for any other reason.

Third Party Providers
All transactions with third party providers are solely between the visitor and the individual provider. CyberLynk is not the agent, representative, trustee or fiduciary of you or the third party provider in any transaction.

All discounts, promotions and special third party offers may be subject to additional restrictions and limitations by the third party provider. All transactions with third party providers are subject to the terms and conditions under which the provider agrees with you to provide the goods or services. You should confirm the terms of any purchase and/or use of goods or services with the specific provider with whom you are dealing.

We do not make any representations or warranties regarding, and are not liable for, the quality, availability, or timeliness of goods or services provided by a third party provider. You undertake all transactions with these providers at your own risk. We do not warrant the accuracy or completeness of any information regarding third party providers.

2. Invoicing and Payment Information

You agree to supply appropriate payment for the services received from CyberLynk, in advance of the time period during which such services are provided. You agree that until and unless you notify CyberLynk of your desire to cancel any or all services received, those services will be billed on a recurring basis.

Cancellations must be done via our secure client portal https://secure.cyberlynk.net or by sending an email to billing@cyberlynk.net. Once we receive your cancellation and have confirmed all necessary information with you via e-mail, we will inform you in writing (typically email) that your account has been canceled. Your cancellation confirmation will contain a ticket/tracking number in the subject for your reference, and for verification purposes. An employee will confirm your request (and process your cancellation) shortly thereafter. We require that cancellations of service are done through the secure client portal billing email address to (a) confirm your identity, (b) confirm in writing you are prepared for all files/emails to be removed, and (c) document the request. This process reduces the likelihood of mistakes, fraudulent/malicious requests, and ensures you are aware that the files, emails, and account may be removed immediately after a cancellation request is processed.

As a client of CyberLynk, it is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You agree that until and unless you notify CyberLynk of your desire to cancel any or all services received (by the proper means listed in the appropriate section of the Terms of Service), those services will be billed on a recurring basis, unless otherwise stated in writing by CyberLynk. CyberLynk reserves the right to bill your credit card or billing information on file with us. CyberLynk provides a 7 day grace period from the time the invoice is generated and when it must be paid. Any invoice that is outstanding for 7 days and not paid will result in a $10 late fee and/or an account suspension until account balance has been paid in full. The $10 late fee is applied in addition to whatever else is owed to CyberLynk for services rendered. Access to the account will not be restored until payment has been received.

It is the customer’s responsibility to notify our billing team via email at billing@cyberlynk.net after paying for a domain renewal and to ensure the email is received and acted upon. Domain renewal notices and invoices are provided as a courtesy reminder and CyberLynk cannot be held responsible for failure to renew a domain or failure to notify a customer about a domain’s renewal.

Subsequently, domain renewals are billed and renewed at least 30 days before the renew date. It is the customer’s responsibility to notify our billing team via our secure client portal https://secure.cyberlynk.net or by sending an email to billing@cyberlynk.net for any domain registration cancellation. No refunds can be given, once a domain is renewed. All domain registrations and renewals are final.

CyberLynk reserves the right to change the monthly payment amount and any other charges at anytime

Payment via Credit Card
CyberLynk accepts payments via MasterCard, VISA, AMEX, and Discover. Usage of a credit card indicates authorization to cover all future recurring charges and additional fees with the credit card on file. Credit cards will be charged on the renewal date for the account. Accounts will renew automatically on the 1st of month following the billing cycle the customer has selected unless proper cancellation notice is submitted to our billing department. CyberLynk also reserves the right to charge the past due amounts to the credit cardthat is on file for your account.

Payment via PayPal
CyberLynk accepts PayPal payments.

Payment via Check and Wire Transfer
CyberLynk accepts personal check, company check and wire transfer. All funds must be payable in US dollars. CyberLynk does not accept international checks in foreign currencies. Payment for services by check must be received prior to renewal dates to avoid interruption of service. Check payments are not available for every service offering. If you would like to pay by check please contact billing@cyberlynk.net for more information. Wire transfer information available upon request.

Returned Check & Chargeback Fees
In the event that a check is returned, service will be immediately suspended and customer will be sent a suspension e-mail allowing seven (7) days to rectify the situation. If within the seven (7) days the customer fails to pay all service fees, including a $25.00 reactivation fee and a $25.00 returned check fee, the customer's account will be permanently cancelled. Such cancellation does not relieve client’s obligation for payment under the terms of the hosting agreement. Cancellation includes the removal of all files on the account. In the event of a chargeback, CyberLynk will immediately suspend all services until such time as full payment is received in addition to a $25.00 chargeback fee and a $25.00 account restoration fee.

Late / Non-Payment
Accounts with Non-Usable Credit Cards

Credit cards on file are not usable when any of the following occur:

  • The card expired
  • The bank declines the charges
  • The card is reported lost or stolen
  • The card is declared invalid
  • You will receive an invoice 7 days prior to your renewal.
  • After 7 days pass you will receive a reminder email regarding the outstanding balance.
  • On the 10th day, you will receive a suspension notice with the date your account will be suspended.
  • If your balance has not been brought to zero, the account will be suspended (a $25 reactivation fee may apply).
  • If payment has still not been made, we will leave the service in its spot offline for 1 week. If we have not heard back from customer or received payment, service will be taken offline and terminated.
  • ALL FILES WILL BE DELETED FROM OUR SYSTEMS.

Collection Fees

You agree to pay all collection costs and reasonable fees including attorneys’ fees, incurred in the collection of any amount past due.

All invoices are sent via e-mail. There is no charge for this service.

3. Cancellations and Refunds

CyberLynk reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.

Exchange rate fluctuations for international payments are constant and unavoidable. All refunds are processed in U.S. dollars, and will reflect the exchange rate in effect on the date of the refund. All refunds are subject to this fluctuation and CyberLynk is not responsible for any change in exchange rates between time of payment and time of refund.

Customers may cancel at any time via our secure client portal https://secure.cyberlynk.net or by sending an email to billing@cyberlynk.net. CyberLynk provides an unconditional 30 day money back guarantee on shared hosting and reseller hosting solutions for any customer who paid the first invoice with a credit card or with PayPal.

Cancellations requested after the initial 30 days for Shared and Reseller accounts will go into effect on the renewal date for that particular hosting package. Unless specifically requested, the account will remain active until the period expires. If the account is eligible, any request for a refund outside of the initial 30 day period will be given on a prorated basis with any previous extended term discount withheld. Refunds are to be determined once the account has been canceled. Payments older than 60 days may require a refund via PayPal or mailed check due to our merchant account policies and procedures.

The following methods of payments are non-refundable, and refunds will be posted as credit to the hosting account:

  • Bank Wire Transfers
  • Checks

There are no refunds on domain names, dedicated servers, software licenses, administrative fees, and install fees for custom software.

Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

Violations of the Terms of Service will waive the refund policy.

4. Service Guarantee

Money back Guarantee
On dedicated servers and colocation no full refund will be honored — the 30 day money back guarantee does not apply. We reserve the right to refund a prorated amount or no refund at all.

CyberLynk’s shared, VPS, and reseller hosting services carry a 30 day unconditional money back guarantee. If you are not completely satisfied with our services within the first 30 days of your service, you will be given a full refund of the contract amount. The 30 day money back guarantee does not apply to domain names, dedicated servers, software licenses, administrative fees, and install fees for custom software.

CyberLynk will not activate new orders or activate new packages for customers who have an outstanding balance with CyberLynk. For a new order to be setup or a new package to be activated, you must have a balance of $0.00, unless otherwise stated by CyberLynk in writing. For customers where CyberLynk has written off a balance in the 3 years due to non-payment CyberLynk will require the customer to pay that amount in addition to the balance for new services before the new order will be setup and provisioned.

Uptime Guarantee
If your shared / reseller server has a physical downtime that is not within the 99.9% uptime you may receive a credit to your account. Approval of the credit is at the discretion of CyberLynk dependent upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the IIS/Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please contact sales@CyberLynk.net with justification. All requests must be made in writing via email. Uptime guarantees only apply to shared / reseller solutions and FTP hosting. All claims will be researched by CyberLynk and we will have the final say in what constitutes a breach in our Service Level Agreement. Customer has up to 3 days after suspected downtime to submit a claim. Credits will be issued within 10 business days from the receipt of a claim according to the following credit scale:

  • 99.9% uptime and above – No credit
  • 99.8% uptime – 10% credit
  • 99.7% uptime – 20% credit
  • 99.6% uptime – 30% credit
  • 99.5% uptime – 40% credit
  • 99.4% uptime – 50% credit
  • 99.3% uptime – 60% credit
  • 99.2% uptime – 70% credit
  • 99.1% uptime – 80% credit
  • 99.0% uptime – 90% credit
  • Less than 99% uptime – full month credit

5. Reseller: Client Responsibility

Resellers are responsible for supporting their clients. CyberLynk does not provide support to our Reseller’s Clients. If a reseller’s client contacts us, we reserve the right to place the client account on hold until the reseller can assume their responsibility for their client. All support requests must be made by the reseller on their clients’ behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients’. CyberLynk will hold any reseller responsible for any of their clients actions that violate the law or the terms of service.

6. Price Change

The amount you pay for hosting will never increase from the date of purchase unless you are required to upgrade due to resource usage. We reserve the right to change prices listed on CyberLynk.net or one of Family of Technology brand websites, and the right to increase the amount of resources given to plans at any time. Customer package pricing will never increase due to price changes unless customer terminates service and signs up for new service.

7. Coupons

Discounts and coupon codes are reserved for first-time accounts *or first-time customers* only and may not be used towards the purchase of a domain registration unless otherwise specified. If you have signed up using a particular domain, you may not resign up for that domain using another coupon at a later date. Any account found in violation of these policies will be reviewed by our sales department and the appropriate invoices will be added to the account. Coupon abuse will not be tolerated and may result in the suspension or termination of the account. Coupons or discounts are only valid towards the initial purchase, and do not affect the renewal or recurring price.

8. Arbitration

By using any CyberLynk services, you agree to submit to binding arbitration. If any disputes or claims arise against CyberLynk or its subsidiaries, such disputes will be handled by an arbitrator of CyberLynk’s choice. An arbitrator from the American Arbitration Association or the National Arbitration Forum will be selected in the state of Wisconsin. Arbitrators shall be attorneys or retired judges and shall be selected pursuant to the applicable rules. All decisions rendered by the arbitrator will be binding and final. The arbitrator’s award is final and binding on all parties. The Federal Arbitration Act, and not any state arbitration law, governs all arbitration under this Arbitration Clause. You are also responsible for any and all costs related to such arbitration.

9. Disclaimers and Warranties

(a) THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CYBERLYNK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. CYBERLYNK MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. NO ADVICE PROVIDED BY CYBERLYNK OR ANY OF ITS REPRESENTATIVES WILL CREATE A WARRANTY.

(b) CYBERLYNK WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR MULTIPLE DAMAGES, EVEN IF CYBERLYNK WAS ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. CYBERLYNK ’S MAXIMUM LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT WILL NOT EXCEED THE TOTAL AMOUNT OF FEES BILLED TO CUSTOMER DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

(c) CYBERLYNK WILL HAVE NO LIABILITY WHATSOEVER FOR ANY CLAIMS, LOSSES, ACTIONS, DAMAGES, SUITS, OR PROCEEDINGS RESULTING FROM: (i) OTHER CYBERLYNK CUSTOMERS OR THIRD PARTIES ACCESSING CUSTOMER’S DATA OR ASSIGNED COMPUTERS; (ii) SECURITY BREACHES; (iii) EAVESDROPPING; (iv) DENIAL OF SERVICE ATTACKS; (v) INTERCEPTION OF TRAFFIC SENT OR RECEIVED USING THE EQUIPMENT OR SERVICE; (vi) CUSTOMER’S RELIANCE ON OR USE OF THE EQUIPMENT OR SERVICE; (vii) MISTAKES, OMISSIONS, INTERRUPTIONS, DELETIONS OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION, OR OTHER FAILURES OF PERFORMANCE OF THE EQUIPMENT OR SERVICE; (viii) THE ACCURACY, COMPLETENESS, AND USEFULNESS OF THE SERVICE; OR (ix) LOSS OF DATA OR LOSS OF ACCESS TO DATA.

(d) CYBERLYNK ’S LIMITATIONS AND EXCLUSIONS OF LIABILITY SET FORTH IN THIS SECTION AND IN THIS AGREEMENT APPLY EQUALLY TO CYBERLYNK ’S OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, REPRESENTATIVES, SUPPLIERS, SUBSIDIARIES, PARENTS, AND AFFILIATED COMPANIES.

10. Third Party Claims & Indemnity

(a) Promptly after CYBERLYNK’s request, Customer will notify any third party, in writing, that CYBERLYNK is not responsible for (i) any content or materials posted on any Customer hosting service or otherwise disseminated through Customer’s use of the Service or (ii) any use or abuse of the Service whatsoever by Customer or any third party.

(b) Customer will defend and indemnify CYBERLYNK (including its officers, employees, agents, contractors, representatives, suppliers, subsidiaries, parents, and affiliated companies) from any third party claim arising out of or related to: (i) alleged Customer conduct that would breach this Agreement, including without limitation alleged infringement of third party intellectual property or privacy rights; (ii) Customer’s use, misuse, or failure to use the Service; and (iii) any action taken by CYBERLYNK as part of an investigation into a suspected violation of this Agreement or as a result of its conclusion that a violation has occurred. Such Customer obligation includes payment of losses, expenses, damages, and costs, including without limitation attorneys’ fees.

11. Disclosure to law enforcement

CyberLynk may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.

12. Changes to the TOS

CyberLynk reserves the right to revise its policies at any time without notice.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising under or relating to this Agreement shall be brought exclusively in the state or federal courts located in Milwaukee County, Wisconsin, and you hereby consent to the personal jurisdiction and venue of such courts.

14. Severability

If any provision of this Agreement shall be held or made invalid by a court decision, statute or rule, or shall be otherwise rendered invalid, the remainder of this Agreement shall not be affected thereby.

Indemnification

You agree to indemnify, defend and hold harmless, CyberLynk Network, Inc, its subsidiaries and other affiliated companies, its officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms of Use. CyberLynk Network, Inc reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with CyberLynk Network, Inc in asserting any available defenses.

Jurisdictional Issues

Unless otherwise specified, the materials in the CyberLynk Network, Inc Web site are presented solely for the purpose of entertainment and promoting programs and other products available in the United States, its territories, possessions, and protectorates. This site is controlled and operated by CyberLynk Network, Inc from its offices within the State of Wisconsin, United States of America. CyberLynk Network, Inc makes no representation that materials in CyberLynk Network, Inc’s Web site are appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with their local laws, if and to the extent local laws may be applicable. This agreement shall be governed by, construed and enforced in accordance with the laws of the State of Wisconsin, as it is applied to agreements entered into and to be performed entirely within such State. CyberLynk Network, Inc is very respectful about the privacy concerns of the visitors to its sites on the Internet. CyberLynk Network, LLC is committed to maintaining a safe and secure Internet environment. We have zero tolerance for the misuse of our infrastructure for abusive, malicious, or illegal activity. This policy outlines how to report abuse originating from CyberLynk-operated IP space, as well as our approach to investigating and mitigating abuse.

We respond to abuse reports promptly during business hours and triage urgent security or law enforcement-related issues 24/7.

Types of Abuse We Handle

CyberLynk investigates and responds to the following categories of abuse (not exhaustive):

1. Email Abuse

  • Spam, unsolicited bulk email (UBE)
  • Phishing or fraud attempts
  • Spoofing, fake headers, forged return paths
  • SMTP open relays or compromised web forms

2. Malware Hosting & Botnet Activity

  • Distribution of viruses, trojans, ransomware, or spyware
  • Command-and-control (C2) infrastructure for botnets
  • Fast-flux hosting or DNS abuse

3. Denial of Service (DoS/DDoS)

  • Participating in or originating flood attacks
  • Amplification/reflection services (e.g., NTP, DNS)
  • Abuse of vulnerable services for outbound attacks

4. Compromised Systems

  • Servers exploited to host phishing pages, malware, or proxies
  • Brute-force attempts or outbound SSH/FTP attacks
  • Abuse linked to unpatched software or credential theft

5. Web & API Abuse

  • Hosting fake login pages or credential harvesters
  • API scraping, rate-limit evasion, or automation
  • Probing or reconnaissance scans

6. Intellectual Property Infringement

  • Hosting pirated content, cracked software, or counterfeit goods
  • DMCA violations (handled via separate DMCA Policy if applicable)

7. Policy Violations

  • Breach of our Acceptable Use Policy (AUP)
  • Violation of brand-specific terms (e.g., FreePBXHosting, TalkAnywhere)

Investigation & Remediation Process

  1. Initial Triage: We verify the report for authenticity and relevance.
  2. Customer Notification: If abuse is confirmed or suspected, we contact the account owner for remediation.
  3. Action Timeline:
    • Critical issues (e.g., malware C2, phishing) may lead to immediate suspension.
    • Low-impact reports are given 24–48 hours for resolution.
  4. Cooperation: We fully cooperate with law enforcement and security researchers when reports are legally and ethically valid.

Data Protection & Responsible Disclosure

We take privacy seriously. Abuse report data is only shared with:

  • The affected customer (where appropriate)
  • Law enforcement or legal authorities when required
  • Internal personnel on a need-to-know basis

Proactive Abuse Controls

CyberLynk actively monitors for abuse through:

  • Internal logging and anomaly detection
  • Public blacklists and reputation feeds (Spamhaus, AbuseIPDB, etc.)
  • Routine audits of SMTP, DNS, and other services

Repeat abuse or failure to remediate may result in service suspension or termination per our Terms of Service and Acceptable Use Policy.

CyberLynk Acceptable Use Policy

1.) Content

All services provided by CyberLynk may only be used for lawful purposes. The laws of the State of Wisconsin and the United States of America apply.

The customer agrees to indemnify and hold harmless CyberLynk from any claims resulting from the use of our services.

Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of another’s copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being infringed upon, please email abuse@CyberLynk.net with the information required. A list of required information may be found here. If the request is of a licensing issue, we may require further documentation.

Using a shared account as a backup/storage device is not permitted, with the exception of one cPanel or Plesk backup of the same account. Please do not take backups of your backups.

Examples of Prohibited Content or Activities

The following content and activities are not permitted on any of our Shared, Reseller, or Dedicated hosting services:

  • Hacking, Cracking, or Security Bypass Tools
    Including brute-force tools, IP/network scanners, exploit archives, or penetration testing software intended for unauthorized use.

  • Pirated or Unauthorized Content
    Includes warez, cracked software, license key generators, or websites distributing or linking to pirated media (e.g., software, movies, music, games).

  • Illegal, Fraudulent, or Misleading Sites
    Examples include phishing pages, advance-fee fraud (e.g., "419 scams"), escrow scams, impersonation of legitimate businesses, fake investment schemes, or any site listed on anti-fraud databases (e.g., aa419.org, escrow-fraud.com).

  • Anonymous Services or Circumvention Tools
    Such as proxy scripts, VPN gateways intended to bypass content filters, anonymizers, or Tor exit nodes. You may not use a dedicated server, virtual server, or colocated server primarily as a VPN or similar service for the purpose of concealing identity, location, or network origin. Legitimate VPN use for secure remote access to your own services (e.g., a firewall VPN used to connect employees to hosted resources) is permitted.

  • Spamming or Unsolicited Messaging
    Including bulk email software, mail bombers, push-button mailers, spam relay scripts, or anonymous/bulk SMS gateways.

  • Adware, Click Fraud, and Revenue Manipulation
    Including AutoSurf, Pay-To-Click (PTC), Pay-To-Surf (PTS), Pay-Per-Click (PPC) abuse, click farms, or ad fraud schemes.

  • Commercial File or Media Hosting Services
    Such as clone sites of Photobucket, Tinypic, RapidShare, or unauthorized audio/video streaming platforms.

  • Live Streaming of Copyrighted Events Without Authorization
    This includes rebroadcasting of sports, pay-per-view events, or entertainment programming (e.g., UFC, NFL, NBA, FIFA, WWE, etc.).

  • Unlicensed Financial Services
    Including high-yield investment programs (HYIP), Forex platforms, E-Gold or cryptocurrency exchanges, Prime Bank instruments, or unregulated securities sales.

  • Unlawful Commerce or Pharmaceuticals
    Offering controlled substances, research chemicals, or prescription drugs without verified legal authorization or licensing.

  • Gaming Servers or Text-Based Games (unless explicitly allowed)
    Examples include MUDs, MMORPGs, persistent browser-based games (PBBGs), or other resource-intensive game engines.

  • IRC (Internet Relay Chat) Servers or Bots
    Includes IRCD servers, bots, or scripts used for IRC operations.

  • Banner Exchange or Ad Rotation Networks
    Hosting or operating large-scale banner ad platforms or legacy ad swapping services.

  • Tell-a-Friend or Referral Spam Scripts
    Tools that send unsolicited referral or invite messages on behalf of users.

CyberLynk services, including all related equipment, networks and network devices are provided only for authorized customer use. CyberLynk systems may be monitored for all lawful purposes, including ensuring that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of CyberLynk system(s) constitutes consent to monitoring for these purposes.

Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Access to networks or systems outside of your direct control must be with expressed written consent from the third party. CyberLynk may, at its discretion, request and require documentation to prove access to a third party network or system is authorized.

We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our Tterms of Sservice in any manner may be removed from our servers (or otherwise disabled), with or without notice.

Failure to respond to email from our abuse department within 8 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via trouble ticket/email and will have a response within 8 hours.

Sites hosted on CyberLynk.net’s and our Family of Technology Company service(s) are regulated only by U.S. law. Given this fact, and pursuant to Section 230(c) of the Communications Decency Act, we do not remove allegedly defamatory material from domains hosted on our service(s). The only exception to this rule is if the material has been found to be defamatory by a court, as evidenced by a court order. CyberLynk.net is not in a position to investigate and validate or invalidate the veracity of individual defamation claims, which is why we rely on the legal system and courts to determine whether or not material is indeed considered defamatory. In any case in which a court order indicates material is defamatory, libelous, or slanderous in nature; we will disable access to the material. Similarly, in any case in which a US Court has placed an injunction against specified content or material; we will comply and remove or disable access to the material in question.

The language of Section 230(c) of the Communications Decency Act fundamentally states that Internet service providers like CyberLynk.net and many of CyberLynk.net’s other web hosting services and brands are republishers and not the publisher of content. Our service merely provides a hosting platform and space on which to host content, and any creation or publication of content on our services is the sole responsibility of the third-party user which creates or publishes the content. Therefore, CyberLynk.net should not be held liable for any allegedly defamatory, offensive or harassing content published on sites hosted under CyberLynk.net’s web hosting service(s).

Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita):

  • Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.
  • Resellers: we will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; more than one infraction of this type may result in the immediate termination of your account.
  • Direct customers: Your services will be terminated with or without notice.

Violations will be reported to the appropriate law enforcement agency.

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.

2.) General Service Resources

Resource Usage
User may not:

  • Use 25% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
  • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  • Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
  • Participate in any file-sharing/peer-to-peer activities
  • Run any gaming servers such as counter-strike, half-life, battlefield1942, etc.
  • Run cron entries with intervals of less than 15 minutes.
  • Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.
  • When using PHP include functions for including a local file, include the
    local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")
  • To help reduce usage, do not force html to handle server-side code (like php and shtml).
  • Only use https protocol when necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencrypted communications.

Backup Policy
For its own operational efficiencies and purposes, CyberLynk from time to time backs up data on its servers, but is under no obligation or duty to Subscriber to do so under these Terms. IT IS SOLELY SUBSCRIBER’S DUTY AND RESPONSIBILITY TO BACKUP SUBSCRIBER’S FILES AND DATA ON CYBERLYNK SERVERS, AND under no circumstance will CYBERLYNK be liable to anyone FOR DAMAGES OF ANY KIND under any legal theory for loss of Subscriber FILES AND/or data on any CyberLynk server. CyberLynk will not attempt to back up accounts that exceed 50,000 files or 30 Gigs of space for any reason.

Unless the customer has specifically purchased a backup solution for website & email hosting, VPS, Dedicated server or colocation hosting services it is solely the subscriber’s duty and responsibility to backup subscriber’s files and data.

Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists”, purchased lists, and selling of lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.

CyberLynk reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.

CyberLynk reserves the right to charge the holder of the account used to send any unsolicited e-mail a cleanup fee or any charges incurred for blacklist removal. This cost of the cleanup fee is entirely at the discretion of CyberLynk.

General Shared & VPS Hosting Email Policy
There is a 500 outgoing email hourly limit per domain. This limit is also applied towards Mailman. If you send over this amount in any hour, most of the e-mails will bounce back with an undeliverable error. If this occurs, it will then take some time for your account to be able to send again so we recommend waiting at least 1 hour after this issue occurs to begin sending email again.

Many of our servers have a limit of 30 POP3/IMAP checks per hour per each user’s connecting IP address. If you go over this you’re likely to get a wrong password error message or an error stating “login incorrect”. If this occurs, please wait an hour and it will automatically unblock you. To prevent this from happening again, please make sure to disable auto checking or at least set it to something higher such as once every 10 minutes.

Any mailing list larger than 5,000 addresses will require a dedicated server or VPS hosting solution from us. Note: Dividing one large list into smaller lists to get below this limit is not allowed.

Mailing Lists Rules
1. Any time you’re sending a message no matter how large your e-mail list is you must throttle it. We recommend you throttle it to at the very least sending 1 email every 8 seconds. (Sending 1 every 8 seconds would send 450 emails within 1 hour, keeping you below the 500 outgoing email limit.) If the mailing list software you’re using does not allow you to throttle you must switch to an application or script that will. We recommend PHPList, which can be found in your CPanel under Softalicous.

IMPORTANT: If you do not throttle and you try sending 500 emails, the server will try sending all 500 in 1 second which is not possible on our shared servers. This will cause a very high load on the server and the entire server will be sluggish, potentially affecting your sites and service, until this sending process is completed. It is our job to keep the server up and running without being sluggish or experiencing issues. Anyone who causes the server’s load to go high will be suspended and the process will be terminated. If you choose not to throttle, you will most likely be suspended for crashing the server.

  1. Any mailing list over 900 email addresses is only allowed to be sent to during off-peak times to prevent high server loads. Off peak times qualify as all day Saturday and Sunday, and 1AM – 8AM Eastern Standard Time, Monday through Friday.
  2. The list must be a Double Opt-In list. This means a user has subscribed for a newsletter or other email marketing messages by explicitly requesting it and confirming the email address to be their own. Confirmation is usually done by responding to a notification/confirmation email sent to the email address the end user specified. The double opt-in method eliminates the chance of abuse where somebody submits someone else’s email address without their knowledge and against their will. You will not be permitted to mail any mailing list that you were given or purchased. In doing so, this will also be considered spamming and may result in termination of the offending account.

Email Scripts must be able to handle and document all information from a double opt-in list. This includes processing opt-outs (via web or email) and list removal on bounce backs. All opt-outs or bounce back removals must be handled in a timely manner, and outbound mail must be throttled on shared packages to a maximum of five hundred (500) emails per hour. If your account is found to be using a script that does not meet these requirements, CyberLynk reserves the right to suspend, terminate, or deactivate your script or account.

  1. Any unsolicited e-mail being sent will result in suspension or termination of the offending account. We take a zero tolerance stance against sending of unsolicited e-mail and other forms of spam.
  2. Any mailing list MUST comply with all guidelines set forth by the United States government. These can be found at:

  3. No direct SMTP mailers are allowed. An example of this would be a Darkmailer or The Bat!. Any mail should be sent through the local mail server/MTA for further delivery by the server and not done directly by scripts.

General Dedicated & Colocation Email Policy

  1. The list must be a Double Opt-In list. This means a user has subscribed for a newsletter or other email marketing messages by explicitly requesting it and confirming the email address to be their own. Confirmation is usually done by responding to a notification/confirmation email sent to the email address the end user specified. 3.) Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

What “Unlimited” means. CyberLynk does not set an arbitrary limit or cap on the amount of resources a single Subscriber can use. In good faith and subject to these Terms, CyberLynk makes every commercially reasonable effort to provide its Subscribers with all the storage and bandwidth resources needed to power their web sites successfully, as long as the Subscriber’s use of the service complies with these Terms. By not setting limits on key resources, we are able to provide simple, consistent pricing to our Subscribers as they grow their online presence. As a result, a typical web presence may experience periods of great popularity and resulting increased storage without experiencing any associated increase in hosting charges.

What “Unlimited” DOES NOT mean. CyberLynk employs complex mechanisms to protect its Subscribers and systems from abuse. CyberLynk’s offering of “unlimited” services is not intended to allow the actions of a single or few Subscribers to unfairly or adversely impact the experience of other Subscribers.

CyberLynk’s service is a shared hosting service, which means that multiple Subscriber web sites are hosted from the same server and share server resources. CyberLynk’s service is designed to meet the typical needs of small business and home business website Subscribers in the United States. It is NOT intended to support the sustained demand of large enterprises, internationally based businesses, or non-typical applications better suited to a dedicated server. CyberLynk will make every commercially reasonable effort to provide additional resources to Subscribers who are using their website(s) consistent with these Terms, including moving Subscribers to newer and bigger shared servers as necessary. However, in order to ensure a consistent and quality experience for all Subscribers, CyberLynk does place automated safeguards to protect against any one site growing too quickly and adversely impacting the system until CyberLynk can evaluate said sites resource needs.

Unlimited Hosting Space; excessive MySQL files. CyberLynk does not set arbitrary limits on the amount of disk space a Subscriber can use for the Subscriber’s website, nor does CyberLynk charge additional fees based on an increased amount of storage used, provided the Subscriber’s use of storage complies with these Terms. Please note, however, that the CyberLynk service is designed to host websites. CyberLynk does NOT provide unlimited space for online storage, backups, or archiving of electronic files, documents, log files, etc., and any such prohibited use of the Services will result in the termination of Subscriber’s account, with or without notice. Accounts with a large number of files (inode count in excess of 200,000) can have an adverse effect on server performance. Similarly, accounts with an excessive number of MySQL/PostgreSQL tables (i.e., in excess of 1000 database tables) or of database size (i.e., in excess of 3GB total MySQL/PostgreSQL usage or 2GB MySQL/PostgreSQL usage in a single database) negatively affect the performance of the server. CyberLynk may request that the number of files/inodes, database tables, or total database usage be reduced to ensure proper performance or may terminate the Subscriber’s account, with or without notice.

Unlimited File Transfer. If the hosting package states ‘Unlimited File Transfer’ CyberLynk does not set arbitrary limits on the amount of visitor traffic a web site, VPS or dedicated server can receive or on the amount of content a Subscriber can upload to his/her/its website, VPS or dedicated server in a given month, nor does CyberLynk charge additional fees based on increased use of bandwidth, as long as the Subscriber’s use of the Services complies with these Terms. In most cases, a Subscriber’s web site will be able to support as much traffic as the Subscriber can legitimately acquire. However, CyberLynk reserves the right to limit processor time, bandwidth, processes, or memory in cases where it is necessary to prevent negatively impacting other Subscribers.

Unlimited Domain Hosting. CyberLynk does not set arbitrary limits on the number of domain names a Subscriber can associate with the Subscriber’s web hosting account.
